Terms of Service

1. Acceptance

These Terms of Service (the “Terms”) form a binding agreement between you and Famio (“Famio”, “we”, “us”). By creating an account, downloading the Famio app, or otherwise using our products or website (together, the “Service”), you confirm that you have read these Terms and agree to be bound by them. If you do not agree, do not use the Service.

2. The service

Famio is a family-organiser application offering a shared calendar, lists and meal planning, chores and rewards, and a manual household budget view. The Service is provided on an ongoing basis and may evolve as we add, change, or remove features.

3. Eligibility & accounts

  • You must be at least 18 years old, or the age of majority in your country, to create an adult account.
  • You agree to provide accurate information and to keep it up to date.
  • You are responsible for safeguarding your password and for activity that occurs under your account. Tell us at contact@famio.app if you suspect unauthorised access.
  • One person, one adult account. You may not transfer your account to anyone else.

4. Households & kid profiles

When you create a household you become a household administrator. You decide who joins your household and what each member can see. By inviting another adult, you confirm you have their permission to share household information with them.

Kid profiles are created and managed by an adult household member. By creating a kid profile, you confirm you are the parent or legal guardian of that child (or have the parent or guardian’s consent), and you take responsibility for that child’s use of the Service. We process personal data of children only on the basis of verifiable parental consent (in accordance with the Data Protection (General) Regulations under Kenya’s Data Protection Act, 2019; COPPA in the United States; GDPR Article 8 for users in the EU/EEA and UK; and equivalent local laws elsewhere). 5. Subscriptions, trial & billing

Famio is offered as a paid subscription, “Famio Premium”. Pricing is:

  • Web: $20 per month or $200 per year, in USD.
  • iOS and Android: $25 per month or $250 per year, in USD or the local-currency price shown by the store.
  • Free trial: Eligible households receive one 14-day trial after entering payment details. A trial used on one platform is not available again on another platform.

Web subscriptions are sold by Paddle, our merchant of record. Paddle handles payment, tax, receipts, refunds, and subscription management. Mobile subscriptions are sold by Apple or Google. Famio does not process or store your full payment-card details.

Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of that period. You can cancel at any time through the provider you purchased from:

  • Web: Famio Billing or the secure management link in your Paddle receipt
  • iOS: Settings > [your name] > Subscriptions > Famio
  • Android: Google Play app > Profile > Payments & subscriptions > Subscriptions > Famio

When you cancel, your access continues until the end of the current billing period and will not renew. Refund requests are handled by Paddle, Apple, or Google under the policy of the provider you purchased from. Consumers keep any non-waivable statutory rights under local consumer law (see section 18).

Price changes will be notified to you at least 30 days in advance via in-app notice or email, and where required by your store, you will be asked to confirm the new price before the next renewal.

6. Acceptable use

You agree not to:

  • Use the Service unlawfully or for unlawful purposes;
  • Access, tamper with, or use non-public parts of the Service, or another household’s data;
  • Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures;
  • Reverse-engineer, decompile, disassemble, or attempt to derive source code, except to the extent these restrictions are prohibited by law;
  • Use the Service to send unsolicited communications, malware, or harmful content;
  • Upload content that infringes intellectual-property rights, contains personal data of others without lawful basis, or is unlawful, abusive, hateful, sexually explicit, or harmful to minors;
  • Use the Service to develop a competing product, scrape data, or train machine-learning models without our written permission;
  • Use the Service if you are subject to comprehensive US, UK, EU, or UN sanctions, or are located in a country subject to such a comprehensive embargo.

7. Your content

You own the content you create in Famio (events, lists, notes, photos, budget entries, and similar). You grant us a limited, worldwide, royalty-free licence to host, copy, transmit, display, and process that content solely to operate and improve the Service for you and your household. We will not use your content to train machine-learning models, sell it, or share it with third parties for marketing.

You are responsible for ensuring that you have the right to upload any content you share through the Service, including any personal data of other people in your household.

8. Our intellectual property

The Service, including the Famio name, logo, design, app, website, and all software, is protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. We reserve all rights not expressly granted.

9. Third-party services

The Service uses third-party providers (e.g. Supabase for hosting and authentication, RevenueCat for subscription management, Paddle for web billing, Apple Push Notification service, Firebase Cloud Messaging, and Sentry for crash reporting). Their use of any data is governed by their own terms; see our Privacy Policy.

10. Payment-provider terms

Paddle (web). Paddle is the seller and merchant of record for web subscriptions. Paddle's checkout, buyer terms, privacy notice, and refund process apply to web purchases in addition to these Terms.

Apple App Store (iOS). These Terms are between you and Famio, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any product warranty claims, product liability claims, or third-party intellectual-property claims relating to the app. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with the Apple Media Services Terms and Conditions when using the app on iOS.

Google Play (Android). Your use of the app on Android is also subject to the Google Play Terms of Service. Where these Terms conflict with mandatory provisions of the Google Play Terms, the Google Play Terms control to the extent of the conflict.

11. No professional advice

The budget features in Famio are for personal household tracking only. They are not financial, accounting, tax, or investment advice and should not be relied on for those purposes. Famio is not a bank, payment provider, or financial institution.

12. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted operation. Nothing in these Terms excludes or limits warranties that cannot be excluded under applicable consumer law.

13. Limitation of liability

To the maximum extent permitted by law, Famio will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or related to the Service.

Where liability cannot be excluded under applicable law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you have paid Famio in the twelve (12) months immediately preceding the event giving rise to the claim or (b) USD 100. Nothing in this clause limits liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be limited by law.

14. Indemnity

You agree to defend, indemnify, and hold harmless Famio from any third-party claims arising out of (i) your breach of these Terms, (ii) your misuse of the Service, or (iii) your content. This indemnity does not apply where your liability is excluded by applicable consumer law.

15. Suspension & termination

You may stop using the Service and delete your account at any time from Settings > Account > Delete account. We may suspend or terminate your account, with reasonable notice where practical, if (i) you materially breach these Terms, (ii) we are required to do so by law, or (iii) your continued use poses a security risk to other users. Where we terminate your subscription early without cause, we will refund the unused portion of your most recent payment.

Sections 7 (Your content), 8 (Our IP), 12 (Disclaimer), 13 (Limitation of liability), 14 (Indemnity), 17 (Governing law) and 19 (General) survive termination.

16. Changes to the service or terms

We may modify the Service from time to time. We will give reasonable notice of material adverse changes. If we change these Terms, we will post the new version with an updated “last updated” date and, for material changes, notify you via in-app notice or email at least 14 days before they take effect. Continued use after changes take effect means you accept the new Terms.

17. Governing law & disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-laws principles. Subject to your mandatory consumer rights (see section 18), the courts of Kenya (and in particular the High Court of Kenya at Nairobi) have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

If you are a consumer in the European Union, you can additionally use the European Commission’s online dispute-resolution platform at ec.europa.eu/consumers/odr.

18. Consumer statutory rights

Nothing in these Terms affects mandatory statutory rights that consumers have under local law, including (where applicable) the Kenya Consumer Protection Act, 2012; the EU Consumer Rights Directive; the UK Consumer Rights Act 2015; the Australian Consumer Law; or analogous protections in your country. Where a mandatory law conflicts with these Terms, that mandatory law prevails to the extent of the conflict.

19. General

  • Entire agreement. These Terms together with the Privacy Policy form the entire agreement between you and Famio about the Service.
  • Severability. If any provision is held unenforceable, the rest remains in effect.
  • No waiver. Failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms. We may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale.
  • Force majeure. Neither party is liable for failure to perform caused by events outside its reasonable control (e.g. natural disasters, war, civil unrest, cyber-attacks, infrastructure or provider outages).
  • Notices. We give notice via in-app message or to the email address linked to your account. You give notice to contact@famio.app.
